License Grants
The Software is licensed, not sold, to you for use only under the terms of this Agreement. You do not become the owner of the SOFTWARE through your purchase, download or use. GATor Trading Corporation retains ownership of the SOFTWARE and all copies thereof, and reserves all rights not expressly granted to you under this agreement. GATor Trading Corporation grants to you the right to use all or a portion of this Software provided that you agree to the following:
License Restrictions
(i)You may not sell, copy, emulate, clone, rent, lease, adapt, translate, sublicense, decompile, disassemble, or reverse engineer this Software except as specified in this agreement;
(ii) all copyright, trademark, tradename notices are maintained on the Software; and
(iii) The end user agrees to be bound by the terms of this Agreement.
Termination
This Agreement takes effect upon your use of the Software and remains effective until terminated. You agree on termination of this agreement to destroy all copies of the Software in your possession.
Affiliate Partner Program
An TJS Affiliate Partner Program has been put in place for carefully screened applicants. GATor Trading Corporation grants persons within the trading industry, the right to promote the TJS product(s). In return, a referral payment may be made to the promoter. No "White-labeling" of any TJS product is allowed, unless approved by GATor Trading Corporation. All sales and downloads must be implemented through GATor Trading Corporation and the TJS website - no exceptions allowed. GATor Trading Corporation has the right to terminate an affiliate relationship at any time without due cause.
Limitation of Liability
In no event will GATor Trading Corporation be liable to you for any damages, including any lost profits, lost savings, or other incidental or consequential damages arising from the use or the inability to use the software.
Warranty Disclaimer
GATor Trading Corporation does not warrant that the software is error-free or will operate without interruption.
